1. First Scope

The business relationship between the consumer and 1988 Jewellery (= customer) to the following terms and conditions in force at the time the order is placed.

2. Second Contract, notice of the cancellation and return policy
2.1. Conclusion

The customer’s order is an offer to 1988 Jewellery to conclude a sales contract.

When an order is made at 1988 Jewellery, the customer receives an email confirming receipt of order and its details (order confirmation). This order confirmation does not constitute acceptance of the offer but shall only acknowledge that the order was received.

A purchase contract is only concluded with a promise of delivery in writing or by sending the ordered goods to the customer.

2.2. Notice of the cancellation and return policy and their legal consequences

You may renew your contract within 14 days without giving reasons in writing (by letter, fax, e-mail) or if it received the goods before the deadline the customer can return the received goods.

The deadline for cancellation or return policy begins upon receipt of this notification in writing, but not before receipt of the goods by the customer and also does not fulfill the obligations under Article 246 § 2 in conjunction with § 1 Sections 1 and 2 draft Law.

The revocation period is sufficient and enabled you to send the product back to.

If the customer can return the merchandise in whole or in part, or only in deteriorated condition, the customer must pay compensation for lost value. In addition, the customer’s obligation is to pay compensation for any depreciation due to the use of the product to avoid deterioration caused by the goods as his property in use and omitting everything, which impairs their value.

Transportable goods are returned at the cost and risk from 1988 Jewellery.

Obligations to reimburse payments must be made within 30 days. The period begins for the customer with the mailing of notice of revocation or the goods of 1988 Jewellery.

3. Delivery

3.1. Unless otherwise agreed, the product will be delivered from the warehouse to the customer’s 1988 Jewellery delivery address.

3.2. If 1988 Jewellery by contract (see § 2) with no fault of their own to deliver the ordered goods are not in a position, 1988 Jewellery is entitled to rescind the contract. In this case, the customer will be informed that the product is not available. The legal rights of the customer remain untouched.

3.3. If delivery to the customer is not possible, such as the customer is not present at the specified delivery address, the customer bears the costs of the unsuccessful delivery.

4. Prices, shipping costs, due date, payment

4.1. Apply on the website at the time of the order mentioned current prices.

4.2. For payment options in advance by bank transfer and payment will be accepted by cash.

4.3. For insured delivery to the customer 1988 Jewellery charges a flat shipping cost, which is shown separately for each delivery method in the order form. The customers are charged shipping costs for deliveries within Germany but the costs for deliveries to foreign countries is different. The current shipping costs are shown on the website

4.4. When paying by bank transfer, the transfer is made to the following bank account:

4.5. With cash on delivery, the customer pays cash. 1988 Jewellery charges 4 € for the delivery fee.

5. Retention

A right to set off a party only if its counterclaims are legally established or recognized by the other party in writing or uncontested. In addition, the party to exercise a right of retention only insofar as their counterclaims claim is based on the same contract.

6. Retention of title

6.1. The delivered goods stay in 1988 Jewellery’s property until full payment is made and received.

6.2. The customer is entitled to any disposition of the goods before full payment without the express permission of 1988 Jewellery.

6.3. If the customer doesn’t perform the payment of the purchase price in time, 1988 Jewellery is entitled to rescind the contract.

7. Warranty Claims

7.1. If there is a shortage of the goods the law will apply.

7.2. If there is a remedy in the form of replacement , the customer agrees to return the original goods without delay and before delivery of replacement goods at the expense of 1988 Jewellery.

The return of the defective product must be in accordance with the statutory requirements of § § 439, paragraph 4, 346 to 348 BGB.
